3. Client Service Agreements
Our lead generation and marketing services are governed by separate client service agreements executed between Apex Scales Media and each client. These agreements detail the specific scope of work, package terms, setup fees, retainer amounts, lead guarantees, and performance metrics applicable to each engagement.
4. The Apex Guarantee
The Apex Guarantee — 10–15 qualified booked appointments per month or your retainer is waived for that month — is detailed in full within each client service agreement. The service agreement defines the terms of "qualified lead," "booked appointment," and the specific conditions under which the guarantee applies.
5. Intellectual Property
All content on this website, including text, graphics, logos, and design elements, is the property of Apex Scales Media and is protected by applicable intellectual property laws. Campaign assets, ad creative, AI flows, and landing pages created for clients become the property of the client upon full payment of the setup fee, regardless of engagement status.
6. Limitation of Liability
Apex Scales Media shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of this website or our services. Our liability for any claim related to our services is limited to the fees paid by the client during the period directly related to the claim.
7. Dispute Resolution
Any disputes arising from these terms or our services shall first be addressed through good-faith negotiation. If resolution is not reached within 30 days, disputes shall be resolved through binding arbitration in Nassau County, New York, in accordance with applicable laws.
8. Changes to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of the website after changes constitutes acceptance of the updated terms.
